GAS Library Hub Terms of Service

These Terms of Service (the "Terms") govern your use of GAS Library Hub (the "Service") provided by wywy LLC ("we," "us," or "our"). By using the Service, you agree to be bound by these Terms.

Article 1 (Application)

These Terms apply to all relationships between users and our company regarding the use of this Service. Our company may establish various provisions ("Individual Provisions") such as rules for use in addition to these Terms regarding this Service. These Individual Provisions, regardless of their names, constitute part of these Terms. In cases where the provisions of these Terms conflict with the provisions of the Individual Provisions mentioned above, the Individual Provisions shall take precedence unless otherwise specified in the Individual Provisions.

Article 2 (User Registration)

User registration is completed when a registration applicant agrees to these Terms, applies for user registration according to the method prescribed by our company, and our company approves this application. Our company may not approve applications for user registration if we determine that the applicant has any of the following reasons, and we shall not be obligated to disclose any reasons for such decisions.

  1. When false information has been provided in the application for user registration
  2. When the application is from a person who has violated these Terms before
  3. When our company determines that user registration is otherwise inappropriate

Article 3 (Management of User ID and Password)

Users shall properly manage their user ID and password for this Service at their own responsibility. Users may not transfer, lend, or share their user ID and password with third parties under any circumstances. Our company shall consider any login made with a combination of user ID and password that matches the registered information as use by the user who registered that user ID. Our company shall not be liable for any damages caused by the use of user ID and password by third parties, except in cases where our company has willful intent or gross negligence.

Article 4 (Usage Fees and Payment Methods)

This Service is available free of charge. However, if we introduce paid plans in the future, we will notify users in advance and provide such services only with their consent.

Article 5 (Prohibited Acts)

Users are prohibited from engaging in the following acts when using this Service:

  1. Acts that violate laws or public order and morals
  2. Acts related to criminal activities
  3. Acts that infringe intellectual property rights such as copyrights, trademark rights, and others included in the content of this Service
  4. Acts that destroy or interfere with the functions of servers or networks of our company, other users, or other third parties
  5. Acts of commercially using information obtained through this Service
  6. Acts that may interfere with the operation of our company's services
  7. Acts of unauthorized access or attempting to do so
  8. Acts of collecting or accumulating personal information about other users
  9. Acts of using this Service for fraudulent purposes
  10. Other acts that our company deems inappropriate

Article 6 (Suspension of Service Provision)

Our company may suspend or interrupt the provision of all or part of this Service without prior notice to users if we determine that any of the following circumstances exist:

  1. When conducting maintenance, inspection, or updates of computer systems related to this Service
  2. When the provision of this Service becomes difficult due to force majeure such as earthquakes, lightning, fires, power outages, or natural disasters
  3. When computers or communication lines stop due to accidents
  4. When our company determines that the provision of this Service is otherwise difficult

Article 7 (Usage Restrictions and Registration Deletion)

Our company may, without prior notice, restrict all or part of a user's use of this Service or delete the user's registration if the user falls under any of the following:

  1. When any provision of these Terms has been violated
  2. When it is discovered that there are false facts in the registered information
  3. When our company determines that the use of this Service is otherwise inappropriate

Article 8 (Disclaimer)

Our company does not guarantee, either explicitly or implicitly, that this Service is free from factual or legal defects (including defects, errors, bugs, rights violations, etc. related to safety, reliability, accuracy, completeness, effectiveness, fitness for a particular purpose, security, etc.). Our company shall not be liable for any damages caused to users arising from this Service. However, this disclaimer shall not apply if the contract between our company and users regarding this Service (including these Terms) constitutes a consumer contract as defined by the Consumer Contract Act.

Article 9 (Changes to Service Content)

Our company may change the content of this Service or discontinue the provision of this Service without notifying users, and shall not be liable for any damages caused to users thereby.

Article 10 (Changes to Terms of Service)

Our company may change these Terms at any time without notifying users when deemed necessary. If a user begins using this Service after changes to these Terms, that user shall be deemed to have agreed to the changed Terms.

Article 11 (Handling of Personal Information)

Our company shall appropriately handle personal information acquired through the use of this Service in accordance with our company's "Privacy Policy."

Article 12 (Notification or Contact)

Notifications or contacts between users and our company shall be made according to the method prescribed by our company. Our company shall consider the currently registered contact information as valid and send notifications or contacts to such contact information unless there is a change notification from the user following the format separately prescribed by our company, and these shall be deemed to have reached the user at the time of transmission.

Article 13 (Prohibition of Transfer of Rights and Obligations)

Users may not transfer their position under the usage contract or rights or obligations under these Terms to third parties or provide them as collateral without prior written consent from our company.

Article 14 (Governing Law and Jurisdiction)

Japanese law shall be the governing law for the interpretation of these Terms. In the event of disputes arising in connection with this Service, the court having jurisdiction over the location of our company's head office shall have exclusive agreed jurisdiction.
